CATALOG-WEBSITE CONTENTS: FMF Racing believes the contents and specifications of its catalog and website are correct. We assume no liability for any errors in listings, specifications, part numbers, prices or model applications. We reserve the right to change specifications, product descriptions, product quality, pricing and application at any time without notice and without further obligation.
AVAILABILITY: Not all products listed in FMF Racing’s catalog or website are guaranteed to be available at the time of order, if at all. FMF Racing reserves the right to cancel or delay plans for product introduction at its discretion.
BACK ORDERS: All backorders will be automatically shipped UPS-ground when available unless the customer indicates ‘NO BACKORDERS’. Backorders more than 45 days old will be confirmed before shipment.
SHIPPING: The customer is responsible for all shipping charges. All orders are shipped via UPS-ground unless customer makes other arrangements. Customer may, at their expense, request UPS-Red, UPS-Blue or UPS 3-Day service. All product is carefully picked, packed, inspected and in good condition when shipped. Responsibility for the product becomes the customer’s when product is transferred to a common carrier. All shipments must be inspected upon receipt. All claims for damages and shortages are to be made with the carrier.
DISCREPANCIES: For discrepancies not related to damages or shortages, you must contact FMF within five (5) business days of receipt.
DISCLAIMER: All products manufactured and/or distributed by FMF Racing are offered and designed for use with standard machines. FMF Racing makes no claims as to the products effectiveness on modified machines. FMF Racing is the sole determiner of abuse, misuse, installation errors and modifications. We assume no liability for any errors in listings, specifications, part numbers, prices or model applications. We reserve the right to change specifications, product descriptions, product quality, pricing and application at any time without notice and without further obligation. Buyer assumes all risk for any and all damage caused to themselves, a third party and/or property by virtue of failure of these products. By installing and/or using an FMF product, you hereby accept and understand these stated terms and conditions and have followed all instructional steps.
LIMITED WARRANTY: All merchandise manufactured by FMF Racing has a warranty against manufacturing defects for a period of one (1) year from the date of invoice. Warranty is limited to the repair or replacement of defective products. There is no warranty for normal wear and tear, any type of crash damage or for product failure due to improper muffler or packing maintenance. FMF Racing reserves the right to repair, replace or issue an FMF credit for defective product at its discretion. Credits are valid for a period of one (1) year from issuance. No credit will be issued for labor or other costs incurred beyond the value of the original product. Product returned as a warranty after having been used, if found to be defective, is not valued at the full purchase price. A depreciated value will be estimated for used product. Product accepted as a warranty claim and repaired or replaced will be returned via UPS-ground freight no charge. Warranty excludes product that has been modified or where the product was improperly installed, abnormally used or misused. This limited warranty is in lieu of all other guarantees or warranties implied or expressed. This includes, without limitation, any warranties or merchantability and fitment for a particular purpose. We make no warranty as to products distributed by FMF Racing, expressed or implied. We will, however, pass on all warranties made by the manufacturer, who has sole responsibility for performing such warranties. A return authorization number must be issued by FMF Racing before product is returned. Returns must be sent back to FMF Racing freight prepaid. Proof of purchase, such as a copy of the original invoice, must accompany all warranty claims. Warranties will be honored to the direct purchaser only.
RETURNS: No returns are accepted on new or unused product after 30 days of purchase. Returns for warranty consideration must be made within the terms of the limited warranty. Product authorized for return:
Must have a return authorization number (RA#) issued by FMF Racing written on the outside of the parcel
Must include a copy of the original invoice for the item(s) purchased
Must include a letter of explanation
Must be sent back to FMF Racing freight prepaid and shipped as clean as possible
New product must be in original packaging and in a condition fit to sell as new. Authorized returns may be subject to a restocking fee of up to 20% of the original purchase price. No returns are accepted on electrical components. All sales are final on discontinued and close out items.
PAYMENT: Orders may be prepaid by money order, cashiers check or wire transfer. Checks will be accepted from pre-authorized FMF dealer accounts. We accept Visa, MasterCard, American Express and Discover. Cash is not accepted. Any overpayment will be posted as a credit on account or refunded when requested in writing. Credits are valid for a period of one (1) year from issuance. Orders may be shipped COD (cash only) via UPS at the customers’ expense. Buyer agrees to pay all amounts in full to FMF Racing according to the respective invoice. Buyer agrees to pay FMF Racing, as interest, an amount equal to 10% per year, compounded monthly, for amounts past due. Buyer agrees to pay reasonable attorney fees, court costs, collection fees and other expenses incurred by FMF Racing in the event any action is taken to enforce this agreement whether or not a suit is filed.
RETURNED CHECKS AND REFUSED SHIPMENTS: A $25.00 processing fee will be charged for all returned checks. The fee charged for refused shipments is $25.00 or 20% restocking, whichever is greater, plus applicable freight charges. Payment is to be made in full immediately.
TRADEMARKS: FMF Racing's rights in the patents, trademarks, trade names, logos and/or service marks (collectively known as the "FMF Marks") are valuable assets of FMF Racing, and shall remain the sole and exclusive property of FMF Racing. Accordingly, no individual shall have the right to use the FMF Marks in any manner whatsoever without the express prior written consent of FMF Racing. Any and all advertising by dealers related to FMF Racing’s products or utilizing the FMF Marks must be approved in writing at least thirty (30) days prior to the commencement of the promotion. All proposals for advertising should be submitted in writing to the attention of the National Sales Manager c/o FMF Racing, 18033 S. Santa Fe Ave., Rancho Dominguez, California 90221, or via facsimile (310) 900-5699. FMF Racing may approve or disapprove any advertising proposals in its sole and absolute discretion.
